Terms of Service

These Terms of Service govern use of the La Indika website and, where applicable, enquiries, table reservations and restaurant orders made with BURNHAM RESTAURANT LTD trading as La Indika Indian Cuisine. Please read them before using the website or placing an order.

1. About these terms

By using this website you agree to these terms. Separate terms shown by an ordering, payment or delivery platform may also apply to a transaction made through that service. Nothing in these terms removes or limits rights that cannot lawfully be excluded under UK consumer law.

2. Website information

We aim to keep menus, descriptions, prices, opening hours, offers and availability accurate, but restaurant information can change. Photographs are illustrative and presentation may vary. We may correct obvious errors, update content, withdraw items or offers, or change opening hours without prior notice where reasonably necessary.

3. Orders

An order request is subject to acceptance and availability. A contract for an order is formed when the order is accepted by us or by an authorised ordering system acting for us, as applicable. We may refuse or cancel an order before fulfilment where an item is unavailable, information or pricing contains an obvious error, payment is not authorised, delivery is unavailable, or there is a reasonable fraud, safety or legal concern. If payment has already been taken for an order we cancel, the appropriate refund will be arranged.

4. Prices, payment and offers

Prices are shown in pounds sterling and, where applicable, include VAT at the rate required by law. Delivery fees, service charges, minimum spends or other charges should be shown before an order is confirmed. Promotional offers may have specific eligibility rules, dates, minimum spends, exclusions or availability limits. Unless stated otherwise, offers cannot be exchanged for cash or combined where the promotion says they are mutually exclusive.

5. Collection and delivery

Any preparation, collection or delivery time is an estimate unless expressly agreed otherwise. Delays can arise from demand, traffic, weather, third-party delivery services or other circumstances. Please provide accurate contact and address details. For delivery orders, it is your responsibility to ensure that somebody can receive the order at the agreed location and time.

6. Cancellations and refunds

Cancellation rights depend on the nature and stage of the transaction. Prepared food and other goods liable to deteriorate or expire rapidly may be exempt from the statutory cooling-off right that applies to some distance contracts. Once preparation has started, cancellation or a full refund may therefore not be available unless the order is faulty, incorrect, not provided as agreed, or another legal remedy applies. If you need to change or cancel an order, contact us as soon as possible. This section does not affect your statutory rights.

7. Table reservations

Please provide accurate contact details and arrive at the reserved time. We may hold a table only for a reasonable grace period during busy service. For larger parties, events or peak dates we may communicate additional booking conditions, deposits or cancellation requirements before confirming the reservation. Please tell us promptly if your party size or arrival time changes.

8. Allergies and dietary requirements

If you have a food allergy, intolerance or important dietary requirement, please tell us clearly before ordering and speak to a member of staff. Our kitchen handles multiple allergens and, despite procedures intended to reduce risk, we cannot promise an allergen-free environment or guarantee the complete absence of cross-contact. Do not rely only on website descriptions, photographs or dish names when making an allergy decision. Ingredient information and recipes can change.

9. Alcohol

Alcohol is sold only in accordance with licensing law. Age verification may be required and we may refuse an alcohol sale or delivery where lawful age, identification, intoxication or licensing requirements are not satisfied. Promotional alcohol remains subject to these requirements.

10. Customer conduct

When visiting the restaurant or contacting staff, you must not engage in unlawful, threatening, abusive, discriminatory or dangerous behaviour. We may refuse service or ask a person to leave where reasonably necessary to protect staff, customers, property or legal compliance.

11. Acceptable website use

You may use the website for lawful personal and business enquiries relating to our restaurant. You must not attempt to interfere with its operation, introduce malicious code, gain unauthorised access, scrape it in a way that materially disrupts the service, impersonate another person, or use the website for fraud or other unlawful activity.

12. Intellectual property

Unless stated otherwise, the website design, branding, text, graphics, photographs and other content are owned by or licensed to us and are protected by applicable intellectual-property laws. You may view and print reasonable extracts for personal, non-commercial use, but you may not reproduce, republish, sell or commercially exploit substantial website content without permission.

13. Third-party services and links

The website may link to third-party ordering, payment, map, social-media or other services. Those services are outside our direct control and may have their own terms and privacy notices. A link does not mean we accept responsibility for the availability, security or content of an independent third-party service.

14. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability arising from statutory consumer rights that cannot be excluded. Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when the relevant contract was formed, or for business losses arising from consumer use of the website.

15. Events outside reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, such as serious weather, utility or network failures, transport disruption, supplier failure, government action, emergencies or similar events, although your statutory rights remain unaffected.

17. Changes to these terms

We may update these terms when our services, legal requirements or business practices change. The terms applying to an accepted order are those communicated or available at the relevant time, subject to any mandatory legal rights.

18. Governing law

These terms are governed by the laws of England and Wales. If you are a consumer, you retain any mandatory right to bring proceedings in another UK jurisdiction where applicable. The courts with lawful jurisdiction may hear disputes arising from these terms.
